Supreme Court Upholds Individual Mandate of the ACA

Thursday, June 28, 2012

The Supreme Court ruled today that the individual mandate portion of the Affordable Care Act (ACA) is constitutional. It was the majority opinion of the court that the Congress does have the power to impose a tax penalty on those who choose not to comply with the requirement to maintain minimum essential health insurance coverage. On the question of the Medicaid expansion, the court decided that Congress cannot take away all federal funding for states that elect not to expand their program. In other words, states that want to move forward with expanding their Medicaid program can and receive federal funding in order to do so, but if a state does not want to expand, they cannot lose their federal funding for their entire program.
