TAC is under contract to the Connecticut Department of Mental Health & Addiction Services (DMHAS) for TAC Executive Director Kevin Martone to serve as the court-appointed Remedial Expert overseeing implementation of an Olmstead settlement in the State. Approval of the settlement agreement, which resolves a lawsuit filed in 2006 by the Connecticut Office of Protection and Advocacy for Persons with Disabilities (OPA), and supported by the Judge David L. Bazelon Center for Mental Health Law and the law firm Stroock & Stroock & Lavan LLP, requires the state to meet its obligation under the Americans with Disabilities Act (ADA) and the U.S. Supreme Court's Olmstead decision to provide housing for people with mental illness in the most integrated setting with appropriate supports. As a result, approximately 130 people with mental illnesses currently housed in two nursing homes in the state will be given the opportunity to transition to community-based homes within 18 months. The settlement also provides that persons admitted to the nursing homes during the four-year term of the agreement will be evaluated for transition to community-based housing within one year of admission. In addition, the state will provide supportive services to the former nursing home residents, including case management, mobile crisis services, employment assistance, and peer support.
